1. INITIAL PROVISIONS.<\/b><\/b><\/p>\n

1.1 This Discovery Product Appendix forms an integral part of the Sales Order and shall be read in conjunction with such Sales Order and the governing Agreement<\/span><\/p>\n

<\/b><\/p>\n

2. DEFINITIONS.<\/b><\/b><\/p>\n

2.1 \u201cAdditional Services\u201d means all additional services provided by Bloomreach to Customer other than those included with the Bloomreach Services, limited to integration services, professional consulting service hours and training purchased in the applicable Sales Order, and excludes load\/performance testing, and products and services provided on a subscription basis.<\/span><\/p>\n

2.2 \u201cAPI\u201d means any http GET request made to Bloomreach Discovery module endpoints.<\/span><\/p>\n

2.3 \u201cCatalog\u201d means a collection of Documents specific to a single language. Each language requires its own Catalog.<\/span><\/p>\n

2.4 \u201cDocument\u201d (also referred to as \u201cIndexed Products\u201d) means a data record that represents either a product, product variant, SKU, or content item being searched. The total Documents reflects the total number of data records within each Catalog. This count includes the additional Documents needed to support use cases where a single data record can become multiple Documents.\u00a0<\/span><\/p>\n

2.5 \u201cDocumentation\u201d means any technical specification documentation, technical product descriptions, user guides and technical integration guides relating to the Bloomreach Services provided by Bloomreach to a Customer and\/or published at https:\/\/documentation.bloomreach.com\/.<\/span><\/p>\n

2.6 \u201cDomain\u201d means the web or other digital pages under the domain(s) specified in the applicable Sales Order for display on the supported devices, native applications and other platforms specified in the Sales Order.<\/span><\/p>\n

2.7 \u201cEvent\u201d means any user interaction with content processed, tracked or generated in connection with the Bloomreach Services, including but not limited to email or SMS notifications, page visits, transactions or data input.<\/span><\/p>\n

2.8 \u201cLarge Catalog\u201d means a Catalog with 6,000,000 or more Documents<\/span><\/p>\n

2.9 \u201cMaximum Event Storage\u201d or \u201cMES\u201d means the maximum amount of data points (Events) attached to the Account that can be stored in the Bloomreach platform at any given time.<\/span><\/p>\n

2.10 \u201cMonthly Processed Events\u201d or \u201cMPE\u201d means all data points (Events) attached to the Account created via API or any other import source in the respective calendar month.<\/span><\/p>\n

2.11 \u201cMonthly Unique Visitors\u201d or \u201cMUV\u201d means the number of unique individuals that access the site(s) or applications(s). Measured as set forth below, customers of both Engagement and Discovery services will utilize the Engagement definition.<\/span><\/p>\n

a) Discovery: Aggregate number of unique Cookie UID2s in tracked profiles per site. Customer is required to turn on UID2 tracking.<\/span><\/p>\n

b) Engagement: Aggregate number of unique IDs in tracked events across web & app traffic per project, excluding campaign\/ system events.<\/span><\/p>\n

2.12 \u201cSite Page View\u201d means an instance of a webpage loaded (or reloaded) in a browser for a specific site or device.<\/span><\/p>\n

2.13 \u201cSmall Catalog\u201d means a Catalog with under 6,000,000 Documents.<\/span><\/p>\n

2.14\u201cTerritory\u201d means (i) the European Economic Area and the UK if the applicable Sales Order is entered into with Bloomreach B.V.; or (ii) the United States of America if the applicable Sales Order is entered into with Bloomreach, Inc.<\/span><\/p>\n

2.15 \u201cUsage Allowances\u201d means any limitations that Bloomreach Services are or may be subject to, including, but not limited to, MPE, MES, the maximum Event capacity, limit of data queries, the number of users, campaign actions contacts, emails\/SMS, IP addresses, scenarios, imports or any other limitations pursuant to the respective Sales Order or Documentation. If the Sales Order does not stipulate the maximum Event capacity, Monthly Processed Events, Maximum Event Storage, a limitation of one hundred million Events shall apply.<\/span><\/p>\n

<\/b><\/p>\n

3. DISCOVERY SUBSCRIPTION SERVICES<\/b><\/b><\/p>\n

3.1 Availability.\u00a0 Bloomreach will provide Bloomreach Services in the Territory. The Bloomreach Services shall be made available by Bloomreach subject to any unavailability caused by any computer, communications, internet service or hosting\/mailing facility failures.\u00a0<\/span><\/p>\n

3.2 Full provisioning of the Bloomreach Services requires Customer to keep the Bloomreach pixel updated and operational at all times. If Bloomreach notifies Customer in writing of an issue with the pixel and Customer does not resolve the issue within 30 days, Bloomreach may suspend the Bloomreach Services and\/or charge Customer overage fees as set forth in the applicable Sales Order until the pixel is restored to proper working condition.<\/span><\/p>\n

3.3 Subcontractors. If Bloomreach provides hosting services to the Customer under an applicable Sales Order, Customer acknowledges that Bloomreach uses a third-party provider for said services, whose details are available in the following list: https:\/\/www.bloomreach.com\/en\/legal\/subprocessors.\u00a0 Customer acknowledges that Bloomreach uses Google Cloud for the hosting of Bloomreach Discovery services. Customer agrees to be bound by the terms of Google Cloud available at <\/span>https:\/\/cloud.google.com\/terms\/service-terms<\/span><\/a>.<\/span><\/p>\n

3.4 Provision of Services. Bloomreach may utilize the services of independent consultants and third-party contractors (the \u201cConsultants\u201d) from time to time to perform or assist Bloomreach in performing the Bloomreach Services.\u00a0<\/span><\/p>\n

<\/b><\/p>\n

4. RESTRICTIONS AND RESPONSIBILITIES.<\/b><\/b><\/p>\n

4.1 Customer will not, directly or indirectly, during, or after a Term: (a) attempt to download or access the Bloomreach Services (other than remote access to functionality of the software provided through the Bloomreach Services), and\/or (b) make the Bloomreach Services available to any third party by sublicense, lease, sale, transfer, or any other means, and\/or\u00a0<\/span><\/p>\n

4.2 Customer agrees that it will: (a) coordinate with Bloomreach following integration to address any service or technical issues, including ensuring that each Domain is functional, accessible to the public and crawlable by search engines and Bloomreach; (b) provide Customer product feeds in the format specified by Bloomreach and as applicable to the Bloomreach Services; (c) use the Bloomreach Services solely to conduct and support its normal business operations; and (d) ensure each Domain will contain a conspicuous privacy policy that complies with all applicable law, that (i) accurately and completely discloses Customer\u2019s privacy and data collection practices, and (ii) clearly discloses that third party service providers may be placing and using cookies on users\u2019 browsers, or using web beacons or other methods to collect information, in the course of providing services.\u00a0<\/span><\/p>\n

4.3 Exceeded Usage Allowance. Exceeding of the Usage Allowances may result in limitation or unavailability of the Bloomreach Services or be subject to additional Fees. Any service level commitments provided in the SLA shall not apply if the Customer exceeds the contracted Usage Allowances.<\/span><\/p>\n

<\/b><\/p>\n

5. ADDITIONAL SERVICES.<\/b><\/b><\/p>\n

5.1 The scope of Additional Services shall be as set forth in a Sales Order, which shall describe the work to be performed and any applicable fees.\u00a0 Customer\u2019s use of Additional Services will be solely for support of the authorized Bloomreach Services outlined in the applicable Sales Order and subject to the terms of the Agreement.\u00a0<\/span><\/p>\n","protected":false},"parent":0,"menu_order":0,"template":"","class_list":["post-71373","legal","type-legal","status-publish","hentry"],"acf":[],"_links":{"self":[{"href":"https:\/\/www.bloomreach.com\/en\/wp-json\/wp\/v2\/legal\/71373","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.bloomreach.com\/en\/wp-json\/wp\/v2\/legal"}],"about":[{"href":"https:\/\/www.bloomreach.com\/en\/wp-json\/wp\/v2\/types\/legal"}],"version-history":[{"count":1,"href":"https:\/\/www.bloomreach.com\/en\/wp-json\/wp\/v2\/legal\/71373\/revisions"}],"predecessor-version":[{"id":71374,"href":"https:\/\/www.bloomreach.com\/en\/wp-json\/wp\/v2\/legal\/71373\/revisions\/71374"}],"wp:attachment":[{"href":"https:\/\/www.bloomreach.com\/en\/wp-json\/wp\/v2\/media?parent=71373"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
